Will Your Legislators Represent You in 2023?

VOTERS: Do you feel we need a Constitutional Convention to overhaul the 1972 Montana State Constitution, and if so, why?

Because the Montana State Constitution is so important and so vulnerable at present, please read and vote carefully to avoid its demise.

As of 12/21/21, eighteen 2021 Montana legislature laws had been challenged in various Montana Courts around the state at the cost to MT taxpayers of $119,000.  The laws were passed largely along party lines with progressives warning that those laws were unconstitutional and would be challenged.
 
Several of those 18 laws have been ruled unconstitutional or are on hold due to judicial rulings as their constitutionality is being challenged as a result of provisions in Montana’s Constitution.  Our MT Constitution is one of best in the nation.
 
Those favoring these extreme laws are two House reps away from having a 2/3 majority which would allow them to call a Constitutional Convention where, with their majority, they could change the MT Constitution to allow the laws that are being challenged right now and many more.
 
Here are just a few of the 2021 laws being challenged: 
 
HB 334 – Expands exemptions from vaccine requirements
 
Reps. Anderson*, Buttrey*, Galloway*, Gist*, Kerns*, McKamey*, Sheldon-Galloway*, Trebas* and Sens. Fitzpatrick and Hoven voted YES on the above bill.
 
Sens. Boland and Jacobson* voted NO for the above bill.

 
HB 174 – Closes late registration the Friday before election
 
Reps. Anderson*, Buttrey*, Galloway*, Gist*, Kerns*, McKamey*, Sheldon-Galloway*, Trebas* and Sens. Fitzpatrick and Hoven voted YES on the above bill.
 
Sens. Boland and Jacobson* voted NO for the above bill.

 
SB 113 – Limiting the number of words used in a referendum

Sens. Boland and Jacobson* voted NO for the above bill.

 
SB 168 – Revises voter ID laws

SB 102 – Generally revises gun laws to allow conceal carry for guns on MT college campuses

Reps. Anderson*, Buttrey*, Galloway*, Gist*, Kerns*, McKamey*, Sheldon-Galloway*, Trebas* and Sen. Fitzpatrick voted YES on the above bill.

Sens. Boland, Hoven, and Jacobson* voted NO for the above bill.


HB 112 – Requires interscholastic athletes to participate under sex assigned at birth

HB 349 – Removes the authority of MT universities to limit student groups’ access to funding and campus facilities based on a group’s stated beliefs or activities.

HB 136 – Forbidding abortions after 20 weeks of gestation except for a threat to the life of the mother

HB 171 – Forcing a woman to document having seen a medical practitioner before having a medically-induced abortion at any point after egg fertilization.

HB 229 – Preventing women on Medicaid from getting abortions except in a case involving physical health risks, rape, or incest

The MT District and Supreme Courts rely on our MT Constitution as they make decisions.  The courts are protecting our privacy, safety, and environment rights based on the MT Constitution. Many legislators passed laws that attack those rights and will attack our constitution.
